15.8% above the \u00a3105m threshold &#8211; is deemed significant.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-11\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-11.0\">However, the commission accepted Everton&#8217;s arguments for mitigation in relation to the fact the club has:<\/span><\/p>\n<ul data-reactid=\".1784asphff6.0.0.0.1.$list-12\">\n<li class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$list-12.$list-item-0\"><span data-reactid=\".1784asphff6.0.0.0.1.$list-12.$list-item-0.0\">Already been deducted points this season<\/span><\/li>\n<li class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$list-12.$list-item-1\"><span data-reactid=\".1784asphff6.0.0.0.1.$list-12.$list-item-1.0\">Suffered a loss of revenue because of the suspension of a sponsorship deal with Russian company USM<\/span><\/li>\n<li class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$list-12.$list-item-2\"><span data-reactid=\".1784asphff6.0.0.0.1.$list-12.$list-item-2.0\">Made an early admission of guilt<\/span><\/li>\n<\/ul>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-13\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-13.0\">The commission concluded that the fact Everton have already been punished this season &#8220;for losses in years which overlap with the years at issue in these proceedings&#8221; merits a two-point reduction in punishment, with a further point for the loss of sponsorship revenue and early admission of guilt.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-14\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-14.0\">It also said that the club and league remain in dispute over costs related to the new stadium &#8211; with the Premier League saying these costs should count as PSR losses, while Everton argue they should be excluded and have capitalised them on their latest audited accounts.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-15\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-15.0\">The same independent commission will meet to decide the issue at a later date and, if it agrees with the Premier League, could issue further punishment.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-16\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-16.0\">However, the commission said this issue cannot be dealt with using the expediated PSR process introduced this season so is unlikely to be resolved before the end of the campaign.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-17\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-17.0\">An Everton statement read: &#8220;While the club&#8217;s position has been that no further sanction was appropriate, the club is pleased to see that the commission has given credit to the majority of the issues raised by the club, including the concept of double punishment, the significant mitigating circumstances facing the club due to the war in Ukraine, and the high level of co-operation and early admission of the club&#8217;s breach.&#8221;<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-18\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-18.0\">The Toffees added that the club is &#8220;extremely concerned&#8221; at the &#8220;inconsistency&#8221; of the punishments, with four different commissions issuing four different points deductions this season.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-19\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-19.0\">The Premier League said the independent commission &#8220;reaffirmed the principle that any breach of the PSRs is significant and justifies, indeed requires, a sporting sanction&#8221;.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-20\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-20.0\">Nottingham Forest are the other Premier League club to have been charged with PSR breaches this season and were <\/span><a href=\"https:\/\/www.bbc.co.uk\/sport\/football\/68594865\" class=\"story-body__internal-link\" title=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-20.$link-2\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-20.$link-2.0\">docked four points in March,<\/span><\/a><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-20.3\"> although they have lodged an appeal.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-21\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-21.0\">Championship club Leicester have also been <\/span><a href=\"https:\/\/www.bbc.co.uk\/sport\/football\/68580638\" class=\"story-body__internal-link\" title=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-21.$link-2\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-21.$link-2.0\">charged by the Premier League<\/span><\/a><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-21.3\"> for allegedly breaking spending rules during their last three seasons in the top flight.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-22\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-22.0\">There is no guarantee that Everton&#8217;s appeal will be heard before the final games of the Premier League season on 19 May when Everton travel to Arsenal.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-23\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-23.0\">The 2023-24 season technically remains &#8216;live&#8217; until the annual general meeting in June when relegated clubs transfer their certificates and 24 May has been selected as a &#8216;backstop date&#8217; for the appeals process to be concluded.<\/span><\/p>\n<figure class=\"gs-u-mt0 gs-u-mb-alt+ story-body__media story-body__media--figure qa-story-body-media\" data-reactid=\".1784asphff6.0.0.0.1.$image-25\"><span class=\"gs-u-display-block story-body__media\" data-reactid=\".1784asphff6.0.0.0.1.$image-25.0\"><span class=\"gs-u-display-block gs-o-responsive-image\" style=\"padding-bottom:56.25%;\" data-reactid=\".1784asphff6.0.0.0.1.$image-25.0.0\"><\/span><\/span><figcaption class=\"gel-brevier gs-u-ph+ gs-u-pv-alt story-body__media__caption story-body__media__caption--image\" data-reactid=\".1784asphff6.0.0.0.1.$image-25.1\">The 2024-25 season is scheduled to be Everton&#8217;s final year at Goodison Park, their home since 1892, before they move to a new stadium at Bramley-Moore Dock<\/figcaption><\/figure>\n<h3 class=\"story-body__crosshead\" data-reactid=\".1784asphff6.0.0.0.1.$crosshead-26\">Everton in transition<\/h3>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-27\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-27.0\">This second deduction comes at a time of significant uncertainty at Everton.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-28\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-28.0\">The club released their accounts covering the 2022-23 season on 31 March, reporting <\/span><a href=\"https:\/\/www.bbc.co.uk\/sport\/football\/68705003\" class=\"story-body__internal-link\" title=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-28.$link-2\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-28.$link-2.0\"> financial losses of \u00a389.1m. <\/span><\/a><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-29\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-29.0\">In September, owner Farhad Moshiri agreed to sell his 94% stake in the club to American investment fund 777 Partners. The takeover is going through the regulatory processes and the club is still waiting for that to be approved by the Premier League.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-30\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-30.0\">Everton are also in the process of building a new stadium on the banks of the River Mersey at Bramley-Moore Dock, which is due to open in 2024.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-31\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-31.0\">Giving evidence to the independent commission, Kevin Thelwell, Everton&#8217;s director of football, said the club was already changing and moving away from its previous business model towards a more sustainable recruitment strategy, but added that &#8220;it&#8217;s a big old ship to turn round&#8221;.<\/span><\/p>\n<h3 class=\"story-body__crosshead\" data-reactid=\".1784asphff6.0.0.0.1.$crosshead-32\">What are the financial rules?<\/h3>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-33\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-33.0\">The PSRs are aimed at promoting financial stability within the Premier League.<\/span><\/p>\n<p class=\"\" data-reactid=\".1784asphff6.0.0.0.1.$paragraph-34\"><span data-reactid=\".1784asphff6.0.0.0.1.$paragraph-34.0\">They were introduced in 2015-16 although the demand to protect clubs from overspending can be traced back to Portsmouth, who in 2010 became the first &#8211;
