{"id":18674,"date":"2024-06-15T06:05:47","date_gmt":"2024-06-15T06:05:47","guid":{"rendered":"https:\/\/kede.com.br\/sport\/lia-thomas-transgender-swimmer-loses-legal-battle-over-ban\/"},"modified":"2024-06-15T06:05:48","modified_gmt":"2024-06-15T06:05:48","slug":"lia-thomas-transgender-swimmer-loses-legal-battle-over-ban","status":"publish","type":"post","link":"https:\/\/kede.com.br\/sport\/lia-thomas-transgender-swimmer-loses-legal-battle-over-ban\/","title":{"rendered":"Lia Thomas: Transgender swimmer loses legal battle over ban"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">American swimmer Lia Thomas has had a legal case against governing body World Aquatics dismissed by the Court of Arbitration for Sport.<\/b><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">World Aquatics (WA) voted in 2022 to stop transgender women from competing in women&#8217;s elite races if they have gone through any part of the process of male puberty.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Thomas, 25, who became the first transgender athlete to win the highest US national college title in March 2022, was attempting to <a href=\"https:\/\/www.bbc.co.uk\/sport\/swimming\/68104658\" class=\"ssrcss-k8mrr8-InlineLink e1kn3p7n0\">overturn that ban at the Court of Arbitration for Sport (Cas)<\/a>, arguing the rules were discriminatory.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Cas first had to determine whether Thomas was eligible to challenge the rules.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In a 24-page verdict, Cas said Thomas was &#8220;simply not entitled to engage with eligibility to compete in WA competitions&#8221; as someone who was no longer a member of US Swimming, &#8220;let alone compete in a WA competition&#8221;, and therefore was &#8220;not sufficiently affected&#8221; by the rules to be able to challenge them.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">WA praised the ruling and said it is a &#8220;major step forward in our efforts to protect women&#8217;s sport&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;World Aquatics is dedicated to fostering an environment that promotes fairness, respect, and equal opportunities for athletes of all genders and we reaffirm this pledge,&#8221; a statement said.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Our policies and practices are continuously evaluated to ensure they align with these core values, which led to the introduction of our open category.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;We remain committed to working collaboratively with all stakeholders to uphold the principles of inclusivity in aquatic sports and remain confident that our gender inclusion policy represents a fair approach.&#8221;<\/p>\n<\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.bbc.com\/sport\/swimming\/articles\/c4nn20w0x0zo\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>American swimmer Lia Thomas has had a legal case against governing body World Aquatics dismissed by the Court of Arbitration for Sport.
